Spain’s Supreme Court retracted all decisions to hand over fugitive businessman Hussein Salem to Egypt on Monday.
Salem appealed to the court that he holds the Spanish nationality and all the charges attributed to him are rather of a political nature than a legal one, reported a local newspaper.
Mubarak-linked Salem demanded in his appeal that the court considers the political situation in Egypt and the changes that have occurred after the uprising.
The same court has ruled against handing over Salem’s children, Magda Salem and Khaled Salem who are also charged of money laundry.
The Spanish National Court had ordered the extradition of Salem to Cairo after an Egyptian court sentenced him to 15 years in prison last June following his conviction in graft and corruption.
The court is considered the highest judicial authority in Spain and its verdict cannot be challenged.
